Starting January 1, 2025, a statutory change to the Coastal Act will allow local governments to submit notices of local coastal development permit actions to the California Coastal Commission via electronic mail. The amendment, through SB 951 (Weiner, 2024), offers a streamlined alternative to certified mail, which also remains as an option.
These notices, commonly referred to as Final Local Action Notices (FLANs) or Notices of Final Action (NOFAs), serve as key communications regarding local actions on coastal development permits. The Commission welcomes the move to electronic submissions as an efficient and convenient option.
FLANs/NOFAs must include all required documents as specified in California Code of Regulations, Section 13571. This includes the conditions and written findings for approval as well as the procedures for appeal of the local decision to the Commission. Until the Commission receives a FLAN/NOFA meeting the requirements of Section 13571 of the Commission’s regulations, the appeal period with the Commission cannot start. Incomplete submissions will be deemed deficient and returned for correction.
